Welcome to Peikly. These Terms of Service (“Terms”) govern your access to and use of the Peikly platform, website, and services. Peikly is a marketing automation platform that enables businesses to manage contacts, automate workflows, and send Email and WhatsApp campaigns.

1. Acceptance of Terms

By accessing or using Peikly, you agree to be bound by these Terms and our Privacy Policy. If you are using the service on behalf of an organization, you agree to these Terms for that organization and represent that you have the authority to bind that entity to these Terms. If you do not agree to these terms, you must not use the service.

2. Description of Service

Peikly provides a suite of marketing automation tools, including but not limited to:

  • Email campaign creation and delivery
  • WhatsApp messaging services
  • Automated communication workflows
  • Contact management and data segmentation

We constantly strive to improve our platform. Accordingly, Peikly may change, suspend, or discontinue any part of the service at any time, including the availability of any feature or database.

3. User Accounts

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Notify us immediately if you discover or suspect any security breaches related to the service.
  • Accept responsibility for all activities that occur under your account.

4. Acceptable Use

You agree not to misuse the Peikly platform. Prohibited activities include, but are not limited to:

  • Sending spam or unauthorized commercial messages in violation of the CAN-SPAM Act, CASL, or any other applicable anti-spam laws.
  • Violating data protection and privacy laws (such as GDPR or CCPA).
  • Uploading, posting, or transmitting any content that is harmful, illegal, abusive, or infringing on third-party intellectual property rights.
  • Misusing third-party integrations, including Email and WhatsApp APIs, in a manner that violates their respective terms of service.
  • Attempting to interfere with the proper functioning of the platform.

5. User Data and Responsibility

You retain all rights to the data you upload to Peikly (“User Data”). However:

  • You are solely responsible for the accuracy, quality, and legality of User Data.
  • You must ensure you have obtained all necessary consents and permissions to contact your recipients via Email or WhatsApp.
  • Peikly acts as a data processor and is not responsible for any misuse of customer data by you or your authorized users.

6. Payments, Subscriptions, and Billing

Peikly is a paid subscription-based service. By selecting a plan, you agree to pay all applicable fees, including taxes.

  • Billing Cycles: Subscriptions are billed on a recurring basis, either monthly or annually, depending on your selection.
  • Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel through your account settings before the renewal date.
  • Non-Refundable Fees: All payments are final and non-refundable once the service has been used. This includes active subscriptions, used credits (Email/WhatsApp sends), and partially used billing periods.
  • No Refunds: No refunds will be issued for any used services or active subscription periods.
  • Payment Failure: If payment fails, we reserve the right to suspend your access to the service immediately. Continued non-payment may lead to permanent account termination.

7. Third-Party Services and Integrations

Peikly integrates with various third-party providers (e.g., WhatsApp Business API, SMTP providers, payment gateways). Your use of these integrations is subject to the terms of those third parties. Peikly is not responsible for any downtime, service errors, or policy changes initiated by these external providers.

8. Service Availability and Limitations

While we aim for maximum uptime, Peikly does not guarantee that the service will be uninterrupted or error-free. Scheduled maintenance, emergency updates, or third-party outages may occur. Message delivery rates are subject to the limitations of external networks and recipient mail/message servers.

9. Limitation of Liability

To the maximum extent permitted by law, Peikly shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data. We do not guarantee specific marketing results, such as conversion rates or engagement levels, from the use of our platform.

10. Termination

You may stop using the service and cancel your account at any time. Peikly reserves the right to suspend or terminate your account without notice if we determine you have violated these Terms, engaged in prohibited use, or failed to pay subscription fees.

11. Intellectual Property

All rights, title, and interest in the Peikly platform, including software, branding, logos, and proprietary technology, remain the exclusive property of Peikly. You are granted a limited, non-exclusive license to use the platform during your active subscription period.

12. Modifications to Terms

We may update these Terms from time to time. If we make significant changes, we will notify you via the platform or email. Your continued use of Peikly after such updates constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Dubai, United Arab Emirates, without regard to its conflict of law provisions.
